Dealer speaks out against automakers being allowed to keep defects quiet

> Update 3/1/2015 - GREAT VIDEO by NBC's WRC-TV: Dealer Jack Fitzgerald says that in the past, auto manufacturers have punished him financially for speaking out.
> Update 3/10/2015 - In this article published yesterday, Jack sums things up admirably: "People have lost lives on the road because manufacturers have hidden safety problems by delaying recalls, and forcing dealers to withhold critical information."
> Update 3/11/2015 - Toyota, GM, and Ford are being sued for concealing the fact that their vehicles are susceptible to hackers wresting control from drivers, and Toyota has announced another recall involving defective software and electronics - this time raising safety issues about transmissions and steering. Wonder if dealerships were ordered to keep quiet about these issues.

One of the auto industry's most appalling practices involves refusing to inform customers about known defects. Generally speaking, it falls under the heading "secret warranties," and Jack Fitzgerald, president of Fitzgerald's Auto Malls in Maryland is speaking out against the practice. Refusal to divulge defect information to customers is a racket that's been going on for decades.

Mr. Fitzgerald is uniquely qualified to address the issue since his dealership is massive in size and handles all brands. As one would expect, his efforts to promote free speech and full disclosure are being opposed by the auto industry.

Of course, the larger point is that keeping defects secret amounts to fraud, and should have been outlawed long ago at the federal level. The fact that automakers can get away with such crookedness further evidences the fact that our current system of government - local, state, and federal - is controlled not by the people it deceitfully claims to represent, but by powerful special interests such as those associated with the auto industry. Meanwhile, the blood-spattered scandals of murderous corporations like Toyota, GM, Takata, etc. ad nauseum continue unabated as the "Just Us" Department keeps watch to make sure no auto executive winds up in prison.

Were it not for public safety implications, it would be laughable that an auto dealer must ask government for permission to warn customers about manufacturing defects. Mr. Fitzgerald is to be applauded for daring to speak out against such a pervasively corrupt system.

Manufacturing defect + Koua Fong Lee's account + similar accounts of runaway '96 Camrys = 100% Toyota's fault

It doesn't make sense to hold Koua Fong Lee 40% accountable for the tragic accident that claimed the lives of three people. You can't have it both ways. Either the vehicle had a manufacturing defect in the accelerator assembly or it didn't. The jury ruled that it did, giving credence to testimony given by Lee as well as other drivers who said they had unintended acceleration problems with '96 Camrys. So how on earth did the jury jump from agreeing with the crux of Koua's case to concluding that he was 40% at fault for the accident? It's anybody's guess as to how such a thing happened, and I certainly hope the miscarriage of justice is remedied on appeal.

The entire matter boils down to corroborating evidence of Lee's account of what happened. Fact is, such evidence has been there by the boatload ever since the accident occurred. The penniless immigrant was railroaded from the get go, and the disgraceful spectacle continued throughout his effort to sue Toyota - an admitted crook that deserves to be known as the Coverup King of the automotive industry - for a manufacturing defect.

Koua's lawsuit was stymied at the outset by a ridiculous legal shenanigan which took away his right to claim punitive damages. If anyone ever deserved punitive damages from an automaker, it's Koua Fong Lee, who spent a whopping two and a half years in prison as a consequence of Toyota's now-established manufacturing defect. And don't hand me any nonsense about shifting the blame for Lee's incarceration to Minnesota's sorry excuse for a justice system, then cleverly passing false imprisonment costs along to the taxpaying public. It's time automakers - especially admitted crooks like Toyota - are held accountable to the Nth degree for the consequences - both direct and indirect - resulting from manufacturing defects. Lee was further hamstrung by not being allowed to claim Toyota was guilty of a cover-up. Never mind complaints lodged with NHTSA about unintended acceleration in '96 Camrys. And don't dare to breath a word about the Coverup King - er I mean Toyota - pleading guilty to that federal fraud charge for misleading safety investigators about defective products.

Of course, "Judge Ann" quickly instructed the jury that it couldn't consider Lee's time in prison, nor the automaker's headline-grabbing parade of recalls, some of which resulted in record-setting fines for delays in reporting safety defects. Rounding out the picture, Lee's attorney's plans to present at additional witnesses were also quashed by the ever vigilant "Judge Ann," who kept a watchful eye lest a filthy rich corporate crook - at last count harboring $60 billion just in cash - be treated unfairly. If only folks had the same degree of concern for penniless immigrants and taxpaying citizens...

At one point, the kindly judge even assisted Toyota's attorney during a cross-examination of the hapless immigrant whose "peers" on the jury, I hasten to add, did not include anyone of Hmong descent. But perhaps "Judge Ann's" most notable "assistance" was allowing Toyota to present sworn depositions regarding that crux-of-the-case manufacturing defect. I'm sure the good judge wasn't aware of the fact that it's kinda difficult to conduct a cross-examination of a deposition. No wonder an Associated Press investigation concluded that Toyota uses evasion as a legal tactic.  Moreover, according to Lee's lawyer, Toyota spent "tens of millions" of dollars in an effort to "frame" his client.
Don't get me wrong. Given the lopsided advantages granted to Toyota, it's a miracle the jury established that a manufacturing defect did exist, found Toyota 60% responsible for the accident, and awarded $11.4 million to the plaintiffs, $2.2 million of which will go to Lee. For all that, I'm exceedingly grateful. Unfortunately, the fact remains that many lives have been lost and shattered, the tragic nature of which was addressed quite admirably by a downcast and sorrowful Koua Fong Lee immediately after the verdict.

Toyota, there are some things money just can't buy.

Fire risk exposed in Toyota Avalon - lapdog NHTSA remains silent

Jessie Powell, one of Toyota's many outraged customers, has been blogging about her ongoing nightmare - she's now suing Toyota - that began after she bought a Prius. Jessie Powell's journey - like mine - opened her eyes to "the rest of the story" when it comes to mistreating customers the "Toyota Way."

Jessie has picketed in front of Toyota dealerships wearing a lemon costume, and does an excellent job of exposing various issues associated with the Coverup King. She has produced a wonderful blog post about the fire risk that's now been exposed in 2011-2012 Toyota Avalons, and underscores the fact that NHTSA - the auto industry's little lapdog - has not seen fit to warn the public. Complete with historical perspective and hard-hitting graphics, Jessie's post is wunna those must reads:

Admit it, Toyota: The Camry's sudden surge is what "startled" Koua Fong Lee

Please spread the word: There may be hope yet for folks who were victimized by Toyota regarding the "pre-cat" manufacturing defect in MR2 Spyders.
###

Leave it to the attorneys for an admitted crook to try to pull a fast one in court. As Koua Fong Lee's lawsuit got underway, Toyota's attorney tried to fool the jury into thinking that "when Lee took the off-ramp, he was startled (emphasis mine) by many cars in front of him and stepped on the accelerator instead of the brake." The guise is based on a fallacious 1989 "study" by NHTSA - the automotive industry's little lapdog - that blabbers about unintended acceleration events coming about because the driver is "distracted" or "startled."

A common-sense analysis shows how utterly absurd the notion is, especially when applied to unintended acceleration events that happen on highways, when the driver's foot is most assuredly already on the accelerator, as was the case with Koua Fong Lee. What makes NHTSA's much-ballyhooed "study" so ridiculous is the fact that no explanation is offered regarding precisely why a "distracted" driver would respond by pushing more forcefully on the accelerator pedal.

What actually happens is confirmed by electrical engineer Dr. Antony Anderson in his lengthy and highly detailed study of unintended acceleration events. The driver is "distracted" or "startled" by the sudden surge in the vehicle's SPEED. Because the driver's foot is already on the accelerator, it's implausible - indeed, it's ridiculous - to assert that the driver would respond by pressing harder on the accelerator pedal. Such blabber was cooked up by NHTSA and the automotive industry as part of a well-orchestrated effort to dupe the public. As anyone who's driven a vehicle knows, in such a situation the spontaneous response would be to stomp on the brake pedal. And during Koua's appeal for a re-trial, it was demonstrated - by a burnt brake light filament - that he did just that when his 1996 Camry suddenly picked up speed as he exited the highway.

Another issue the NHTSA blabber conveniently avoids is the fact that runaway vehicles are exceedingly difficult - if not impossible - to stop. Consumer Reports' engineers "found that it's difficult to stop some vehicles with a stuck throttle at highway speeds by pressing on the brakes alone." As did highway patrolman Saylor - the doomed driver of the runaway Lexus ES 350 whose screams for help were caught on a 911 recording - Koua too began screaming that he couldn't stop the car.

What's important to bear in mind is evidence galore confirming Coverup King Toyota's dishonest behavior when the now admitted crook argues a case in court. An Associated Press investigation, concluding that Toyota "has routinely engaged in questionable, evasive and deceptive legal tactics when sued" is apparently an understatement.

I'll say it again: Koua Fong Lee still needs all the luck he can get.

Update 1/13/2015 - The burnt filament in Koua's brake light - proving that Koua had his foot on the brake - was spotlighted in yesterday's testimony by an expert witness. Of course, this had already been established during Koua's bid for a re-trial prior to charges against him being dismissed. Nonetheless, it's appalling that such testimony hasn't been headlined by mainstream media.

Update 1/14/2015 - A mysterious pause in Koua's lawsuit took place yesterday, and it's rumored that Toyota is trying to settle the case out of court. If there's anything admitted crook and Coverup King Toyota can't stand, it's the truth, and lots of it has been coming out since Koua's lawsuit started. Nobody should be surprised if wunna Toyota's "confidential" settlements is reached in an obvious effort to shut things up. Bear in mind that Toyota has been in "settlement mode" ever since that landmark unintended acceleration trial in Oklahoma unveiled evidence of electronic defects in the Coverup King's throttle control: "After the Oklahoma verdict, Toyota's (settlement offer) increased substantially." Stay tuned.

Admitted-crook Toyota granted unfair advantage in Koua Fong Lee's lawsuit

Please spread the word: There may be hope yet for folks who were victimized by Toyota regarding the "pre-cat" manufacturing defect in MR2 Spyders.
###

tt was a hoot watchin' Amerika's so-called justice system exposed for the sham it is when unjustly imprisoned Toyota driver Koua Fong Lee appealed for a re-trial. The public unveiling of how Lee's case was handled confirmed the railroading of a penniless immigrant who found himself at the mercy - or lack thereof - of a pervasively corrupt system ramrodded by the incompetent, the uncaring, the politically motivated, and those hapless souls infected with this country's heritage of racism, which got underway with the American Indian. Evidence abounds - including some of the comments on news articles - that folks of Hmong descent best watch their step 'round the "Twin Cities" of Minnesota.

Once the sham of Lee's "conviction" was exposed - amidst picketing outside the courtroom, and a Facebook page committed to seeing Lee released from prison - there was little the good judge could do except free a guy who had beaten the odds when it comes to reversing injustice. And of course, with Lee winning his bid for a re-trial, his politically astute persecutor - er I mean prosecutor - suddenly saw the light and dropped all charges. She knew better than risk another trial, and that's well and good. But how many other "Koua Fong Lees" are rotting away in Amerika's corporate, run-for-profit prisons? How many other unjustly-imprisoned folks are lucky enough to have a conscientious newspaper reporter intervene, round up high-priced attorneys willing to work pro-bono and stick with the case through thick and thin?

So now we come to the Grand Opening of Lee's well-founded-if-ever-there-was lawsuit, not against Toyota, but against admitted crook Toyota. An automaker unparalleled in the annals of automotive history when it comes to lawsuits galore, congressional inquiries, record-setting fines, retaliation against whistleblowers, dirty deals with auto-industry-stooge NHTSA, and the foul-smelling list goes on ad nauseum, topped off by Toyota's guilty plea to a federal fraud charge, accompanied by $1.2 billion worth of payola forked over to a crooked government in exchange for an end to a federal investigation that threatened to blow the lid regarding evidence of electronic defects in Toyota's throttle control.

Whew. Quite a record the ol' Coverup King has established. But not to worry...

Judge Ann gonna make sure corporate-citizen Toyota - at last count sporting a $60 billion pile of cash - isn't treated unfairly by some upstart immigrant who had the audacity to file suit against the Coverup King. First off, that pesky issue of punitive damages - a consideration that's put Toyota in "settlement mode" ever since the Bookout case (see video at bottom) in Oklahoma - had to be dealt with. No problem. Simply rule that Lee isn't entitled to claim such damages. That oughta teach him to confront the likes of Toyota. No tellin' what a jury might do with a case involving a young plaintiff unjustly imprisoned for many years.

And then there's all this fuss about what the jury might be allowed to consider. Ahem. Yes, let's make sure the jury doesn't start thinking about Toyota's never-ending parade of recalls, the congressional inquiry, the fines for delays in reporting safety defects, and for double-dog certain let's not even mention the part about Toyota being an admitted crook. All the jury needs to know for sure, according to Judge Ann, is the fact that Camrys like the one Lee was driving were never part of any of the Coverup King's - er I mean Toyota's - recalls. And that fact provides the absolute perfect opportunity to rule that this pesky immigrant can't argue that Toyota covered anything up. After all, how could any informed person in their right mind entertain the notion that corporate-citizen Toyota might be somewhat less than forthright about acknowledging safety defects? And never mind that a whole slew of people have already testified that they too had been terrorized when their Camrys - just like the one Lee was driving - suddenly sped out of control. Shame on them for having the unmitigated gall to say so under oath, and it must be bothersome indeed that two of Toyota's "Lee-type Camry" victims will testify as part of Lee's lawsuit.

For icing on the cake, let's put some hefty limits on what the jury can hear regarding the horrors Lee experienced during years of unjust imprisonment. Package things up neatly, and blabber that as far as prison time goes, Lee should be compensated not by Toyota, but by taxpayers.

Right, Judge Ann. Let's bend over backwards to make sure this immigrant's lawsuit is conducted fairly for all concerned, especially a taxpaying public that continues to be put at risk by the shenanigans of a crook like Toyota, propped up by the automaker's good friends in Washington - Repukes n Demagogues alike - who deceitfully pose as representatives of the people.

In his courageous efforts to make truth prevail, Koua Fong Lee still needs all the luck he can get.

Did your MR2 Spyder engine disintegrate? Contact Jenn Strathman at WPTV

Update 3/31/2018 - Jenn and her station refused to expose engine failures in MR2 Spyders. I wonder if someone at WPTV got stung with Toyota's melting dashboards, thereby prompting their exposure of that issue.

With honest coverage of the issue by mainstream media, there may be hope yet for folks who were victimized by Toyota regarding the manufacturing defect in MR2 Spyders. Jenn Strathman and WPTV have demonstrated a concern for consumers with their recent exposure of Toyota's stonewalling response to melting dashboards.

Coverup King Toyota has now agreed to make amends for the dashboards, and a similar result might be obtained if enough folks contacted Jenn about engines disintegrating in MR2 Spyders. Let's give it a try:

Crooked Toyota yields to public exposure on melting dashboards

First, I want to pass along one heartfelt thanks to Jenn Strathman and WPTV for their sincere and persistent efforts at exposing the facts about Coverup King Toyota's problems with melting dashboards. Wow, what an amazing performance in a day and age - as I've addressed many times in this blog - when mainstream media almost always cowers down to crooks like Toyota, and, in essence, joins forces with deceitful corporations as they toss out every dirty trick in the book to bully consumers. Moreover, Jenn's tireless efforts - her first report aired back in April - have underscored the reason crooked corporations - backed by this paid-off government - are so intent on controlling news media.

As consumers have done on a vast variety of other issues - epitomized, incidentally, by all those engine failures in MR2 Spyders - folks yelled and screamed about an obvious manufacturing defect that caused Toyota's dashboards to melt into a gooey, sticky mess, the reflection from which presented an equally obvious safety hazard. And just as Coverup King Toyota and its partner-in-crime NHTSA have done on an endless list of similar situations, the response - actually, the lack thereof - was one of stonewalling, denial, and deceit as the gang attempted to fleece consumers and shut the melting dashboard issue up.

But this time it was different.

An honest mainstream news-media operation with a sincere and competent investigative reporter entered the picture, dared to contact Toyota directly, and broadcast the facts. And lo and behold, the free press, much to Toyota's chagrin, finally got the kind of results consumers are entitled to. It's a profound delight to see a slob like Toyota taken to task by a handful of their irate customers and a bit of good, old-fashioned investigative reporting. The kind of reporting that brings down corruption and frees consumers from having to depend on time-consuming, emotionally-draining, and incredibly expensive lawsuits in an effort to obtain a shred of fundamental fairness. Isn't it amazing how a bit of honest, mainstream-media intervention levels up the playing field? Once again - I can't say it forcefully enough - thanks, Jenn. As I blogged in response to that Oklahoma jury's guilty verdict in Toyota's landmark electronically-induced unintended acceleration case: thank you, thank you, thank you. Visit Jenn's Facebook page. Read the many comments from those who had been victimized for years by Toyota's melting-dashboard scam. Bless you, Jenn. Bless WPTV.

Coverup King and admitted-crook Toyota has now agreed to do what the corporate slob should have done in the first place, without any stonewalling blabber about the dashboard warranties running out. YES. Toyota will now recall millions of vehicles to correct the problem, and reimburse customers who paid to have dashboards replaced.

Nonetheless, look at the lying, deceitful "spin" bully-boy Toyota is putting on the matter. Admitted-crook Toyota has the unmitigated gall to say "We are committed to closely listening to out customers to ensure owner satisfaction." Right. Except in the case of all those engine defects in MR2 Spyders. Except in the case of ongoing unintended acceleration disasters. Except in the case of continuing complaints of oil-sludged engines. Except in the case of... Really, folks. Does Toyota and its government cohorts take people for fools? Is the government-propped-up gang so repulsively self-assured that their unconscionable - and often murderous - abuse of consumers will go on forever? Are they really?

It's time we had a little bit of honesty and bravery in this country. The kind of sincerity and courage exemplified by Jenn Strathman and WPTV. One final time, at least for this post:

THANK YOU, JENN.

Update, 12/19/2014 - Check out photos of the melting dashboards.

Update 12/20/2014 - Toyota says replacement parts won't be available until May of 2015, and it looks like the defective dashboards may also involve potential interference with airbags. So ya gotta wonder if Toyota's parts supplier Takata - now implicated in deaths and injuries associated with shrapnel-slingin', exploding airbags - is involved in the lengthy delay. Just add this to tons of evidence confirming that NHTSA - the so-called safety agency has refused to address the melting dashboards - is a corporate-controlled stooge for the auto industry.

SECRECY: the hallmark of crooks like Toyota

Update 11/1/2014 - A few hours ago: Takata says a new flaw was discovered for airbags it made from 2008-20014.

I just love it when the public is suckered by "proposed legislation" that stands no chance whatsoever of passing after elected officials (don't blame me - I quit voting years ago) are bribed - er I mean educated - by lobbyists. Buys time until well-entrenched business interests can do their thing with America's two-headed, one party sham of an electoral system.

Admitted-crook Toyota is perhaps the most notorious of all when it comes to those "confidentiality agreements" Senator Blumenthal says he wants to outlaw. The Coverup King has been rushing into such agreements like crazy ever since embedded systems expert Michael Barr spilled the beans on the auto industry's unintended acceleration scam about a year ago in that landmark case in Oklahoma. Electronic defects galore were exposed in Toyota's throttle control, ushering in a barrage of settlements structured to keep things quiet the "Toyota Way."

Really, folks. By what convoluted reasoning are crooked corporations like Toyota allowed to purchase the public's right to free speech as part of "settlements" involving deadly defects? It's a bullying tactic that's been going on for many years, Mr. Blumenthal, and never should have been allowed in the first place.

Toyota is still in tantrum mode because word of defects in their throttle control is spreading, thanks to that landmark lawsuit the Coverup King lost in Oklahoma last October. Lately, the admitted crook and first-class bully has been targeting whistleblower Betsy Benjaminson - a single, unemployed mother of four - with a slew of pricey, court-sanctioned actions aimed at intimidating Benjaminson - and anyone else - from daring to exercise free speech. Crooks like Toyota are outraged that in this age of the Internet, bloggers, trade journals, and shrewd use of social media can play havoc with the efforts of bigshot "news" organizations and auto-industry stooges like NHTSA to keep safety issues quiet. Note the graphic - a blood-spattered Toyota emblem - featured in today's update about Benjaminson.

Meanwhile, the latest scandal - exploding, shrapnel-laced airbags that injure and kill - leaves consumers at the mercy of auto-industry thugs, propped up by a corrupt, corporate-controlled government that has "no comment" when truth is exposed.

Update 10/31/2014 - Amidst scandals and recalls galore, the airbag fiasco may be the straw that broke the camel's back. Marketing research shows that consumers are finally getting wary of Toyota's never-ending safety problems now that fundamentals such as airbags and seatbelts are making headlines.

Airbags: Toyota sez "Stay outta the front seat." Better yet, just stay outta their vehicles.

Update 11/2/2014 - "Trust us" indeed (see 10/28 update below). Toyota's response to the airbag fiasco has turned out to be highly controversial. It must be awful to have to depend on an admitted crook and Coverup King like Toyota to do the right thing about defective airbags. Of course, auto-industry-stooge NHTSA quickly approved Toyota's response to the scandal.

Updates 10/28/2014
> Appearing on CNBC, Toyota's Jim Lentz has the gall to say "trust us" regarding airbags. Trust a corporation that pled guilty to a federal FRAUD charge? Talk about a thigh-slappin' HOOT...

> Lawsuits claim Takata knew about the airbag defect in 2001. "Car owners allege they were duped into buying models that weren’t as safe as they were made to believe because of the potentially dangerous air bags ... Representatives for Takata, Honda and Toyota declined to comment..."

So we're expected to believe that Honda has known about the airbag fiasco for years, but Coverup King and admitted-crook Toyota was left unaware. Forgiveness is sought for those of us who find that a bit difficult to believe, and pardon me for bringin' this up, but wonder what else the "world's largest automaker" is "unaware" of. Whatever. Toyota's response to those deadly, shrapnel-slingin' airbags gets more interesting by the minute.

The Coverup King is now advising folks to "keep passengers out of the front seat of several models." Really. And never mind that this sage advice for U.S. customers comes four months after Toyota took similar actions in Japan. Well, I guess stayin' outta the seat is better than trustin' Toyota to disable the things. Bear in mind that among the multitude of recalls Toyota has become infamous for, on occasion they've had to issue second recalls for the same problem 'cause initial efforts to fix things didn't work. Does anyone in their right mind wanna trust an admitted crook to "disable" what amounts to a roadside bomb?

Frankly, with all the software problems Toyota has encountered - not the least of which is computer expert Michael Barr finding electronic defects galore in Toyota's throttle control - I wouldn't bet too heavily on their airbags performing properly even without the bungling from parts supplier Takata. Here's a peek at problems associated with Toyota's airbags.

"Oh what a feeling" indeed. Just make sure passengers don't have it while riding in that front seat.

Updates 10/22/2014 -
> Believe it or not, Coverup King Toyota is supporting Takata's bungling - er I mean handling - of the airbag fiasco. Birds of a feather...

> Just in from USA Today: "NHTSA didn't say why it only now is raising an alarm about the imminent danger of the bags, some of which have been on the roads since 2000, and which began being recalled by automakers in 2008." So the feds are "confused" now that the facts are coming out? Really, folks: If Americans are DUMB enough to tolerate murderous crookedness out of this repulsive little oligarchy - Repukes n Demagogues alike - as it panders to thugs in the auto industry, so be it.

Jury awards Plaintiff $12 million in Toyota lap belt case

“The whole courtroom was in tears, and so was the jury. The evidence was strong; it was an absolute slam dunk.” - Chelsie Hill's father, quoted by KSBW.com news.

Who woulda thought? Coverup King and now-admitted-crook Toyota is having problems convincing juries that it's telling the truth. No wonder Toyota prefers out-of-court, confidential settlements. Even more so since it lost that landmark unintended acceleration case in Oklahoma last October.

It's a real shame that consumers have to file expensive, time consuming, and emotionally draining lawsuits to stand a chance of prevailing against crooked corporations like Toyota. Equally bad that we have a corporate-controlled government kissin' up to these crooks by manufacturing bald-faced lies - no, NASA did NOT rule out electronic defects as a cause of unintended acceleration - and simply "refusing to comment" if anyone dares to confront the auto industry's repulsive little puppets with a few facts.

In Hill's case - involving a 4Runner - admitted-crook Toyota is "expected to appeal." Is anyone surprised?

Update 10/18/14 - Another article puts the situation in proper perspective. Hill's lawyer says "Toyota misled the public about the safety of their lap belts and now there are millions of people out there driving those cars," and Ben Kelley, a Center for Auto Safety board member who testified at the trial, points out that "As of 2014, there are more than 3 million Toyota vehicles with at least one lap belt - similar to the one Hill wore - driving in the U.S."

Update 10/19/2014 - VIDEO: former Assistant Secretary of the Treasury Dr. Paul Craig Roberts offers some GREAT comments on the revolving door twixt this corrupt government's so-called regulators and the industries they puppet for, paving the way for lucrative jobs in those industries. NHTSA (No Help To Solve Anything) and Toyota are prime examples, which probably explains how Toyota's lap belts squeaked by "safety regulators" in the first place. Kudos to Dr. Roberts for pointing out that Americans no longer care if someone has the reputation of being a crook.

Longtime customer who got EDR readout fed up with Toyota

“'There are five Toyotas in my family. We’ve been loyal Toyota people,' Mr. Ruginis said. 'Now I plan to replace all five cars.'"

There'll be no more Toyotas for Bob Ruginis, the guy who lucked out and managed to get his hands on data that confirms his wife's account of what happened when her Corolla sped out of control. In a late breaking interview with local news reporter Patrick Luce, Ruginis discusses his disillusionment with Toyota, and the predicament he's now in, still making payments on a vehicle he doesn't feel safe driving and has moral reservations about selling to anyone else.

Coverup King Toyota has a way of abandoning customers. Ask Jessie Powell. She's in a similar predicament with her Prius. It too sets on a dealership lot as Jessie struggles through a lawsuit against now-admitted-crook Toyota. Jessie has picketed her dealership in a lemon costume, she blogs about her experiences, and she has a Facebook page titled "Route 44 Toyota Sold Me A Lemon".

Caveat emptor.

Details emerge re meeting at Ruginises home to discuss EDR readout

"Even when ODI witnesses Unintended Acceleration with no input from the driver with their very own eyes, they dismiss it." Sean Kane's 9/23/2014 article, "What Good Can Come of Reporting Toyota UA?"

Sean Kane, founder of Safety Research Systems, attended the meeting last Wednesday when two attorneys from the office of Toyota's "Independent" Monitor sat down with the Ruginises - at their home - to discuss matters associated with an EDR readout Mr. Ruginis lucked out and happened to get his hands on. It'll be interesting to see how the Washington gang - especially NHTSA - explains away the hard, cold evidence (see exhibit) of electronic defects in Toyota's throttle control. Evidence that corroborates what embedded systems expert Michael Barr found after an 18 month study of Toyota's much ballyhooed source code. As an adjuct to Mr. Kane's article, read trade journal EDN's article, "Toyota's Killer Firmware: Bad Design and its Consequences." Here's what Mr. Barr found that NHTSA has ignored, Holder's "Just Us" department refuses to comment on, and the government's mainstream media stooges have tried to make sure you don't know about:

* Toyota's electronic throttle control system (ETCS) source code is of unreasonable quality.
* Toyota's source code is defective and contains bugs, including bugs that can cause unintended acceleration (UA).
* Code-quality metrics predict presence of additional bugs.
* Toyota's fail-safes are defective and inadequate (referring to them as a 'house of cards' safety architecture).
* Misbehaviours of Toyota's ETCS are a cause of UA.

Meanwhile, as Mr. Kane points out, Toyota is rushing to settle unintended acceleration lawsuits "faster than you can say Michael Barr." Fact is, Coverup King Toyota has been in settlement mode ever since that pesky unintended acceleration trial in Oklahoma last October whereby Mr. Barr's testimony resulted in a landmark guilty verdict. It's a hoot watching the now-admitted-crook shy away from jury trials in an effort to keep Mr. Barr's findings quiet.

Before you buy a Toyota, reflect carefully on the facts. Their little glitch-mobiles can take you places you don't wanna go.

Update 9/29/2014 - Today, the Associated Press published an update on Mr. Ruginis' request to NHTSA. "The consumer provided 163 reports from other drivers who experienced a surge at low speed or no speed. But NHTSA said it eliminated duplicates, those outside the scope of the 2006-2010 model years and those from foreign countries to get 141. No injuries were reported." The article doesn't name Ruginis, referring only to an "unidentified consumer" who filed an unintended acceleration complaint on 9/11/2014. Of course, that avoids publicizing all those messy details about the EDR readout and what prompted the "unidentified consumer" to file such a complaint.

Update 9/30/2014 - re immediately preceding update, other reports copyrighted AP give complete details, so apparently some news media are deleting relevant information from AP's release.

Update 10/2/2014 - As word spreads about evidence of electronic defects in throttle controls, it's apparent that unintended acceleration affects many makes and models worldwide. Hyundai is being targeted in Korea, and Saudi Arabia is keeping an eye on Coverup King Toyota.

Admitted-crook Toyota chickens out on driverless cars

Talk about a thigh-slappin' hoot:

Toyota - that paragon of the best money can buy when it comes to electronic throttle controls - sez they're not interested in this "driverless" car thing. And nobody can blame 'em. After all, if their vehicles didn't have a driver, who would the admitted crook blame when their little glitch-mobiles sped out of control?

Yessir, with hundreds of pending lawsuits revolving around evidence of electronic defects in that pesky ol' throttle control, they know better than to dabble about in the world of cars that drive themselves. Just think how utterly terrified Toyota must be at the thought of wunna their vehicles speeding out of control with no driver to blame. No possibilities for blabber about pedal confusion, medical conditions, floor mats, or sticky accelerators.

I'll bet Toyota's Washington gang is breathin' a sigh of relief. U.S. Attorney Eric Holder, along with the admitted crook's new "safety monitor," the "investigators" at NHTSA, and our "representatives" in Congress must be high fivin' each other. No tellin' how much sleep they've lost worrying about wunna Toyota's "driverless" vehicles takin' off with nobody and no thing to blame but their good friend's electronics. In fact, I'll bet the entire auto industry is relieved by Toyota's decision to stay out of the "driverless" car business.

Embedded systems expert Michael Barr must be rollin' in the aisles. He's the guy who examined Toyota's much ballyhooed source code for 18 months, found electronic defects galore, and convinced an Oklahoma jury to return a guilty verdict in that landmark unintended acceleration case last October. In spite of a well-orchestrated effort by government, the auto industry, and mainstream media stooges to keep things quiet, word has gotten out about the "house of cards" architecture in Toyota's electronic throttle control. Read trade journal EDN's article, "Toyota's Killer Firmware: Bad Design and its Consequences." Here's what Mr. Barr found:

* Toyota's electronic throttle control system (ETCS) source code is of unreasonable quality.

* Toyota's source code is defective and contains bugs, including bugs that can cause unintended acceleration (UA).

* Code-quality metrics predict presence of additional bugs.

* Toyota's fail-safes are defective and inadequate (referring to them as a 'house of cards' safety architecture).

* Misbehaviours of Toyota's ETCS are a cause of UA.

The jury was so incensed they declared Toyota guilty of reckless disregard in the way the throttle control was designed. Looked bad for the entire auto industry, 'cause other makes - Jeeps are notorious for speeding out of control at carwahes - have also been involved. In fact, as NHTSA (No Help To Solve Anything) stonewalls the evidence, the National Carwash Association has been takin' notes. Is it any wonder that Toyota immediately went into settlement mode when the Oklahoma jury's sentiments were revealed?

Just think of the money ol' Sammy's corporate friends in the auto industry would be be out if they had to install the kinda failsafes that have been required for years in the airline industry. Amidst the current epidemic of runaway vehicles crashing into buildings and causing deaths, injuries, and close calls galore, it all boils down to teamwork. By not dabbling in driverless cars, admitted-crook Toyota is simply doing their part to see that their team prevails. Can't blame 'em fer that, can ya?

Consumers should be thrilled.

Update 9/10/2014 - Speaking of driverless cars, Former Assistant Secretary of the Treasury Dr. Paul Craig Roberts featured some apt remarks in his introduction to a guest article, "Putting Big Brother in the Driver's Seat: V2V Transmitters, Black Boxes & Drones."

Dealership needs to blame Toyota for my picketing

My picketing in front of West Columbia, South Carolina's new Fred Anderson Toyota dealership has continued pretty regularly. This week, one of their employees walked up with a less than cordial demeanor and asked me what my sign, "BEWARE OF TOYOTA" meant. Said he didn't understand the word "beware," so I referred him to a dictionary.

Not long ago, wunna their employees came out and glared at me, and when I first showed up to picket, management came out, told me I couldn't stand in front of the dealership, and then called the cops. Kinda makes ya wonder if they've ever heard of free speech.

I won't belabor the absurdity of sales personnel asking what "beware" means, but the response to my picketing suggests that Toyota's dealerships are influenced by the deceitfulness and bullying tactics of the admitted crook they represent. I'm not surprised that folks have been coming up to tell me of bad experiences they've had at Fred Anderson Toyota.

Instead of targeting me, why doesn't the dealership target admitted-crook Toyota? Why aren't they outraged over corporate crookedness supported by a bought-and-paid-for government? Apparently, the gang at Fred Anderson Toyota thinks it's okay for corporations to stonewall, lie, and treat customers like dirt. So what if MR2 Spyder owners lost the better part of $10,000 due to an obvious manufacturing defect? Toyota's victims are expected to keep their tails firmly tucked as they acquiesce.

The Anderson gang would be better advised to expend their energies going after Toyota. Find the integrity and courage to tell an admitted crook that dishonesty is a bad idea and its putting the dealership at risk of losing business. Former Assistant Secretary of the Treasury Dr. Paul Craig Roberts tells it like it is about the sorry state of affairs in this country: "The city upon the hill, the light unto the world, the home of the exceptional, indispensable people is the home of Satan’s lies where truth is prohibited and war is the end game."

Fred Anderson Toyota needs to realize that their enemy isn't free speech. Their enemy is a corporate-controlled government epitomized by murderous crooks like GM and Toyota.

Hardware and/or software problem exposed in Camry Hybrid brakes

Maybe Michael Barr - the computer expert whose testimony prompted a guilty verdict in the sudden unintended acceleration case in Oklahoma - should be asked to examine the computer issues associated with brake failures in '07 and '08 Camry gas-electric hybrids. Complaints to NHTSA are increasing.

Pesky little problem. Seems those "trouble codes" don't necessarily show up. Kinda reminds ya of instances of sudden unintended acceleration. Brings to mind motorists in runaway cars insisting that they had both feet on the brake pedal.

In one of the complaints to NHTSA, after a dealer finally said there was a problem with the brake control computer, the owner wrote that “Toyota is behaving immoral not recalling the faulty parts that in many cases cannot even be diagnosed.” Hmm... "Difficulties" diagnosing a problem, blabber about "computer codes," and accusations that Toyota is somewhat less than a paragon of morality. Sound familiar? Next thing ya know, Toyota will be blamin' the problem on floor mats, and customers getting the brake pedal confused with the accelerator.

Not to worry. Toyota says they're "cooperating with NHTSA." Problem is, there's growing evidence of a bit too much "cooperation" twixt NHTSA and the Recall King. Sudden unintended acceleration cases ad nauseum, yet it's taken many years and lawsuits galore for the facts to come out. Not to mention deaths, injuries, and one Toyota driver - Koua Fong Lee - who wound up spending years in prison before charges were finally dropped. I'd like to see singer-songwriter Kris Kitko, who produced the superb music video, "Toyota, Where are Ya?" produce a follow-up asking where NHTSA has been all these years.

Things are heatin' up - literally - for the Recall King. NHTSA is considering yet another possible recall, this one associated with the fabric used for heated seats in Camrys and other models. Whew. Will Toyota's parade of defects ever end?

Oh, well. At least everyone can rest assured that NHTSA, our illustrious little government watchdog, will continue to represent the interests of those it serves.

Update 2/1/2014 - Mainstream media is keeping quiet about the evidence of computer problems. AP and Washington Post are the only ones I know of that have mentioned it. Bombshell considering the case in Oklahoma. Should be makin' headlines. As is the case with engine failures in MR2 Spyders, Toyota rakes in big bucks for "servicing" defective products, and has been fined for delays in reporting such items. Consumers have good reason to question how long the Recall King has been aware of the Camry brake issue.

Toyota accused of cover-up regarding software causing sudden unintended acceleration

The founder of the firm that won the big case against Toyota in Oklahoma has produced a video accusing Toyota of a cover-up.

"Toyota knew before the first recalls that there was a problem with the Electronic Throttle Control System, in regards to sudden unintended acceleration, as early as 2004. When you go back and look at the beginning of this problem, they knew about the problem, that's the real tragedy." Jere Beasley, Founder, Beasley Law Firm

No wonder the Recall King now blabbers about needing to be "reborn" in the eyes of its customers. Toyota can talk the talk. But when it comes to walkin' the walk...

Listen up, Akio. "Select shops" don't stonewall about obvious defects that cause engines to suddenly disintegrate, ruin exhaust systems, and deplete customers' bank accounts of the better part of ten thousand dollars. Pocket change to you. Big bucks to most folks. And "select shops" don't make national headlines for every misdeed imaginable, along with a never-ending parade of defects, safety and otherwise. "Select shops" are competent, honest, and treat customers with respect. Toyota is a long way from being viewed as a "select shop" by informed consumers.

The impact of the Oklahoma case cannot be overstated. The Recall King is now in "settlement mode," exemplified by Toyota's response to a sudden unintended acceleration case in West Virginia shortly after the guilty verdict in Oklahoma:

“There seemed to be a pretty clear purpose on Toyota’s part to get a deal done” and keep the case out of court, attorney Edgar “Hike” Heiskell said. “There was a real sense of motivation on that side of the table.” A spokeswoman for Toyota declined comment.

More to the point, Toyota is now rushing to institute a "global settlement that would resolve all of the personal injury and wrongful death product liability cases." Of course, we can expect such a settlement to be structured with Toyota's trademark of confidentiality agreements, thereby keeping incriminating technical data quiet, buttressed with language makin' it crystal clear that the ol' Recall King admits to no wrongdoing. Never mind the ongoing risk to consumers as instances of sudden unintended acceleration continue to make headlines.

Meanwhile, David Strickland, former top dawg at NHTSA, has wormed his way into lobbying for the auto industry:

"We think that the thing industry will be most impressed by was the pass David Strickland gave Toyota's electronics in the Unintended Acceleration crisis. Sure, the government fined Toyota to the max. But the automaker only had to pay penalties for failing to mount timely recalls for floor mat interference and sticky accelerator pedals. NHTSA whitewashed the problems of Toyota's electronic throttle control system."

It's probably no coincidence that Mr. Strickland left NHTSA shortly after Toyota was read the riot act by that jury in Oklahoma. His newfound occupation epitomizes the ol' revolvin' door game, helpin' to insure that unfair business practices continue:

"In perhaps the most glaring case, Toyota staffed up with former NHTSA officials as it faced an inquiry into sudden acceleration in its Toyota and Lexus vehicles. Over 10 years, more motorists died from such accidents in Toyota and Lexus vehicles than in cars from all other manufacturers combined." (Emphasis mine)

Engineers are taking notice of the incriminating evidence against Toyota. The exceptionally well-credentialed Michael Barr, who testified in the Oklahoma case, is scheduled to be the keynote speaker for an EE Times conference set for March 31st through April 3rd.

I just love it when the truth comes out.

Update 2/20/2014 - Actually, the truth came out about Toyota's slick manuevering way back in 2010. "Toyota's deadly secrets" presents a scathing review. "Statistically, Toyota had one speed-control-crash complaint per 20,454 vehicles sold in the United States. This figure is significant when compared to other major auto manufacturers such as Ford: one complaint per 64,679 vehicles; Honda: one complaint per 70,112 vehicles; and General Motors: one complaint per 197,821 vehicles."

Toyota guilty verdict renews interest in sudden unintended acceleration

On the heels of a gulty verdict in a sudden unintended acceleration case in Oklahoma, news of an out-of-control Camry, and cops have nixed the notion of driver error. A 2003 Camry took off immediately after the driver - who was parking the vehicle and still had his foot on the brake - heard a loud, metallic bang. The vehicle - which was totalled - crashed through a wall, seriously injuring the driver's wife.

Meanwhile, in another case involving an out-of-control Camry, plaintiffs are being represented by the same law firm that successfully represented the folks in Oklahoma. "Mr. Kitrys’ 2004 Toyota Camry suddenly and without warning surged out of control and he was unable to stop the vehicle. As the uncontrollable Camry approached an intersection and concrete barrier, Mr. Kitrys jumped from the vehicle but received injuries that caused his death."

Let's hope Toyota doesn't "examine" these vehicles unless both sides are present. I remember the case of Koua Fong Lee, wherein Toyota acted like Koua's Camry belonged to them insteada him.

Meanwhile, electrical engineers are speaking out in favor of the Oklahoma verdict, and Shawn Kane of Safety Research and Strategies, Inc. has offered a detailed summary of the trial's technical issues, noting that experts used the term "spaghetti," which is programmer's slang for badly written and badly structured source code. The trial also revealed that back in 2007, even one of Toyota's own programmers had used the term when referring to the engine control application. Mr. Kane testified on Capitol Hill when congress "investigated" Toyota back in 2010.

Previous congressional testimony - especially from victims of sudden unintended acceleration - takes on new meaning in light of the technical disclosures associated with the guilty verdict in Oklahoma. Great time to recall the testimony of Clarence Ditlow, Executive Director of the Center for Auto Safety. Mr. Ditlow told our illustrious elected officials there was a cover-up, and implicated (gasp) NHTSA. I've maintained from the get go that a corporation that would behave like Toyota has about engine failures in MR2 Spyders simply cannot be trusted. Ditto for a government that lets 'em get away with it.

Amidst the heavy downpour of incriminating technical data from the Oklahoma case, Toyota's NHTSA-congressional whitewash is flakin' off. Not so easy anymore for the Recall King to get away with dumping problems on their customers. Of course, Toyota's USA president even testified back then that 70% of sudden unintended acceleration cases couldn't be explained by driver error, floor mats, or sticky gas pedals. Thanks, Oklahoma. Thank you, thank you, thank you. It's a hoot seein' the Recall King forced into a runnin'-scared rush to settle hundreds of remaining cases - 'bout 450 of 'em - lest there be further technical revelations, along with the fearsome prospect of juried determinations of punitive damages.

Sudden unintended acceleration trial exposed Toyota's shameful conduct

"We proved at trial that the software that controlled the ETCS was defectively designed and failed to conform to industry standards. Moreover, the jury was convinced that Toyota was fully aware of problems with the system, but concealed them from the National Highway Traffic Safety Administration (NHTSA), the public and its customers." Jere I. Beasley, Beasley and Allen Law Firm

SO thrilling that a law firm finally dared to challenge the absurd notion that Toyota's ongoing problems with sudden, unintended acceleration were attributable to floor mats, beer cans, the driver's age, etc. ad nauseum. Once done, Plaintiffs were rewarded with a guilty verdict after a jury in Oklahoma heard the facts about the Recall King's shenanigans involving its electronic throttle control system (ETCS). Enough to prompt the jury to declare that Toyota acted with "reckless disregard" of the Plaintiffs' rights.

In a scathing summation of trial highlights, Plaintiffs' attorney's have not been bashful  regarding Toyota's behavior. Reminiscent of the Associated Press investigation concluding that Toyota is deceitful when sued, it's now obvious that Toyota is deceitful not only when sued. Toyota is deceitful period:

"Toyota’s conduct from the time the ETCS was designed has been shameful. This jury had the courage to let Toyota and the public know that Toyota was reckless and that the automaker had covered up a known defect in the ETCS."

I'll pose the question again: Why should anyone trust anything Toyota says?

Isn't it a outrage that citizens in the sweet land of "liberty and justice for all" have little recourse against slob corporations other than filing expensive, risky, and time-consuming lawsuits? Toyota's friends at NHTSA jumped at the chance to champion NASA's "investigation" of Toyota's sudden, unintended acceleration, and we now have solid evidence that - as common sense dictated all along - NASA's "investigation" left much to be desired:

"Although NASA investigated Toyota’s software, Toyota withheld certain important software source code from NASA and misrepresented the existence of vital memory protection characteristics of the Camry throttle control system."

And when it comes to NHTSA:

"...in reporting to NHTSA, Toyota removed the search term “surge” and only used the term “mat,” which resulted in only 124 claims being reported to the government agency. This was a deliberate move on Toyota’s part and was designed to hide a known defect."

NHTSA wasn't hoodwinked. NHTSA was willfully hoodwinked. And we can expect proof of that infuriating fact to emerge as NHTSA refuses to take action against their friend Toyota in spite of technical disclosures - so far kept secret from the public - now referenced in court records.

Indisputable evidence of the best system money can buy. A government of dishonest, corporate-financed thugs - Repukes and Demagogues alike - who run roughshod over the citizenry. Is anyone surprised that nothing has been done about all those engine failures in MR2 Spyders?

Another big recall. Blogger targets Akio.

Apparently, Toyota is tryin' to get in a few more big recalls before 2013 runs out. The latest recall (fifth biggie for the year, second recall in the past week) involves a whopping 885,000 units, featuring - of all things - spiders tampering with air bag deployment. Call this their "Halloween recall," bringing the total number of recalled units to six million for 2013. According to Toyota (I won't belabor that one), the nasty little critters can even play havoc with the steering. Toyota is "aware" of multiple instances of air bag, etc. malfunctions, resulting in two "minor" injuries.

Don't blame it all on spiders, jus' some of it, sez the Recall King. Now that's good advice. An Omaha woman has just been awarded $6.2 million in her airbag lawsuit dating back to a Lexus crash in 2007. The jury deliberated all of four and a half hours to conclude that not only was the airbag defective, but "the car did not 'conform' to the generally recognized and prevailing state of the art in the industry at the time the 2004 Lexus ES 330 was first sold by Toyota.”

Spiders? Hmm... Reminds me of all those MR2 "Spyders" mysteriously plagued by suddenly disintegratin' engines. Yessir, the 'ol Recall King definitely has a bug problem. Great material for another story in Design News' "Made by Monkeys" section.

Meanwhile, one of Toyota's many irrate customers has created a blog - and a Facebook page - titled "Route 44 Toyota Sold Me A Lemon." Her 10/18/2013 blog post, "Dear Mr. Akio Toyoda:" calls out none other than the Godfather - er I mean the Prince - himself. Reminds me of a post I made several years ago.

Keep these 2013 recalls - failing engines, brakes, airbags, etc. ad nauseum - goin', Toyota. 'Specially those recalls of recalls when the initial recall failed to fix the recall problem. Keep it up. Ya might be able to set another record.

Design News publishes my article

Just want to extend my heartfelt appreciation to Rob Spiegel and Design News for publishing my article about the pre-cat problem in MR2 Spyders. The "Made by Monkeys" section is SO appropriately titled for stories about Recall King Toyota.

I'm honored - sure makes my day :-)

Update 10/16/2013 -
Interesting comment by tekochip:

"Another example of complex systems failing in complex ways. As the pre-catalyst fails you would think that the exhaust gas pressure would keep all the containments from flowing back into the engine, but the MR2 engine features variable valve timing. Under some conditions the valves change their timing to allow a little exhaust gas back into the cylinders, sort of a vale timing version of EGR. So, with the variable valve timing sucking in exhaust and the pre-catalyst failing, the result is containments scoring the cylinder walls and valves."

Rob Spiegel chimed in, confirming that the pre-cat problem is all over the Internet:
"This seems to be a widespread problem with this model. A quick Google search found TONS AND TONS (emphasis mine) of references to pre-cat problems."

Absolute disgrace that government allows corporations like Toyota to kick consumers around with such impunity.

Update 10/19/2013 - I'm delighted to see comments focusing on pre-cat environmental considerations and the EPA. Instead of coddling Toyota with wrist-slappin' fines, and allowing them to cut deals whereby Toyota makes no admission of wrongdoing, government should have reigned the Recall King in long ago on the pre-cat issue.
