Fire risk exposed in Toyota Avalon - lapdog NHTSA remains silent

Jessie Powell, one of Toyota's many outraged customers, has been blogging about her ongoing nightmare - she's now suing Toyota - that began after she bought a Prius. Jessie Powell's journey - like mine - opened her eyes to "the rest of the story" when it comes to mistreating customers the "Toyota Way."

Jessie has picketed in front of Toyota dealerships wearing a lemon costume, and does an excellent job of exposing various issues associated with the Coverup King. She has produced a wonderful blog post about the fire risk that's now been exposed in 2011-2012 Toyota Avalons, and underscores the fact that NHTSA - the auto industry's little lapdog - has not seen fit to warn the public. Picketing: Don't glare at ME, Mr. Salesperson. Glare at TOYOTA.

Yesterday as I picketed Toyota in front of West Columbia, South Carolina's new Fred Anderson Toyota dealership, wunna their sales force came out, stood about 10 or 15 yards away, and glared at me for several minutes. That's fine, if that's what the guy wants to do, but I have a suggestion for the lad: Instead of glaring at me, glare at admitted-crook and Coverup King Toyota. You know. The thug you've chosen to sell vehicles for.

You see, I didn't bring this situation about. Toyota brought it about when they refused to acknowledge an obvious manufacturing defect in MR2 Spyders, turning their crooked backs on hapless owners such as myself, out the better part of $10 grand when the engines disintegrated. Leave it to a bully like Toyota to take advantage of the fact that Spyders were a limited production vehicle, thereby making class-action lawsuits as impractical as individual court pursuits.

Crooked automakers like Toyota, GM, and now Honda have learned that it pays to ignore manufacturing defects. After all, they can get free passes from their bought-and-paid-for "safety" stooges like NHTSA, as the government agency's bigshot employees look forward to being rewarded with high payin' jobs in the auto industry. Meanwhile, the Department of "Just Us" stands guard to make sure nobody goes to prison if and when dirty facts are exposed. Short of time-consuming, expensive lawsuits, there really isn't any viable recourse for consumers. Factor in a tail-tucked public, bullied into accepting any kind of crookedness imaginable, and there you have it: a formula par excellence for immoral and illegitimate profits galore at the consumer's expense, both physically and financially. It's called tyranny, something that's come to be the hallmark of this little police-state, corporate-controlled oligarchy and its corrupt, two-headed, one party sham of an electoral system.

What do you expect me to do, Mr. Salesperson? Knuckle under to the crook you work for, and simply kiss the better part of $10 grand goodby? The next time you get the urge to glare at someone, Mr. Toyota Salesperson, focus your gaze on the culprit instead of the victim.

Update 10/21/2014 - NY Times published a GREAT article yesterday about the growing airbag scandal. "Toyota said it would in some cases disable the air bags, leaving a note not to ride in the front passenger seat."

Longtime customer who got EDR readout fed up with Toyota

“'There are five Toyotas in my family. We’ve been loyal Toyota people,' Mr. Ruginis said. 'Now I plan to replace all five cars.'"

There'll be no more Toyotas for Bob Ruginis, the guy who lucked out and managed to get his hands on data that confirms his wife's account of what happened when her Corolla sped out of control. In a late breaking interview with local news reporter Patrick Luce, Ruginis discusses his disillusionment with Toyota, and the predicament he's now in, still making payments on a vehicle he doesn't feel safe driving and has moral reservations about selling to anyone else.

Coverup King Toyota has a way of abandoning customers. Ask Jessie Powell. She's in a similar predicament with her Prius. It too sets on a dealership lot as Jessie struggles through a lawsuit against now-admitted-crook Toyota. Jessie has picketed her dealership in a lemon costume, she blogs about her experiences, and she has a Facebook page titled "Route 44 Toyota Sold Me A Lemon".

Caveat emptor.

Dealership needs to blame Toyota for my picketing

My picketing in front of West Columbia, South Carolina's new Fred Anderson Toyota dealership has continued pretty regularly. This week, one of their employees walked up with a less than cordial demeanor and asked me what my sign, "BEWARE OF TOYOTA" meant. Said he didn't understand the word "beware," so I referred him to a dictionary.

Not long ago, wunna their employees came out and glared at me, and when I first showed up to picket, management came out, told me I couldn't stand in front of the dealership, and then called the cops. Kinda makes ya wonder if they've ever heard of free speech.

I won't belabor the absurdity of sales personnel asking what "beware" means, but the response to my picketing suggests that Toyota's dealerships are influenced by the deceitfulness and bullying tactics of the admitted crook they represent. I'm not surprised that folks have been coming up to tell me of bad experiences they've had at Fred Anderson Toyota.

Instead of targeting me, why doesn't the dealership target admitted-crook Toyota? Why aren't they outraged over corporate crookedness supported by a bought-and-paid-for government? Apparently, the gang at Fred Anderson Toyota thinks it's okay for corporations to stonewall, lie, and treat customers like dirt. So what if MR2 Spyder owners lost the better part of $10,000 due to an obvious manufacturing defect? Toyota's victims are expected to keep their tails firmly tucked as they acquiesce. 

The Anderson gang would be better advised to expend their energies going after Toyota. Find the integrity and courage to tell an admitted crook that dishonesty is a bad idea and its putting the dealership at risk of losing business. Former Assistant Secretary of the Treasury Dr. Paul Craig Roberts tells it like it is about the sorry state of affairs in this country: "The city upon the hill, the light unto the world, the home of the exceptional, indispensable people is the home of Satan’s lies where truth is prohibited and war is the end game."

Fred Anderson Toyota needs to realize that their enemy isn't free speech. Their enemy is a corporate-controlled government epitomized by murderous crooks like GM and Toyota.

Picketing resumes over engine failures in MR2 Spyders

The Toyota Center - where my MR2 Spyder engine was rebuilt - has now moved into fancy new digs about two miles from my house, under the name Fred Anderson Toyota. Day before yesterday, I got an e-mail inviting me to "join" them for their grand opening.

So I did.

I arrived yesterday afternoon by bicycle, with a sign that read "BEWARE OF TOYOTA" on one side, and this blog's address on the other. It's been quite a while since I picketed a Toyota dealership, and it was good to be back. The thousands of dollars I lost when the engine disintegrated in my MR2 Spyder are still missing from my bank account. I'm just as fed up with now-acknowledged-crook Toyota as I ever was, and I wanna thank passing motorists for the friendly beeps, thumbs ups, and waves. As I've come to expect from Toyota dealerships, several unpleasantries were instigated by dealership personnel.

Over the years - as this blog indicates - my gripe with Toyota has come to be about a lot more than engines disintegrating in MR2 Spyders. Toyota is a murderous, dishonest corporation - backed by a corporate-controlled government - that treats people like dirt. At first, it was a simple effort to get my money back over an obvious manufacturing defect that had been all over the Internet for years. Then I found out about Toyota's disgraceful shenanigans regarding oil sludge. Then the unintended acceleration scandal broke loose, amidst revelations of cover-ups, federal criminal investigations, record-setting fines, deaths and injuries galore, and an endless parade of recalls for every defect imaginable. Not that the government has disciplined the Recall King. It hasn't. Toyota is a filthy rich corporate slob with cash stockpiled to the tune of some $60 billion. Unfazed - as the government well knows - even by payola in the billion dollar range forked over to end criminal investigations. The "Just Us" Department functions primarily as a corporate-controlled tool to make sure crooked auto executives like those at Toyota and GM don't do prison time for their unconscionable deeds.

Currently, Toyota, the government, and the government's mainstream media stooges are trying every trick in the book to keep things quiet about compelling evidence of electronic defects in Toyota's throttle control. Evidence which raises questions about the reliability of electronic throttle controls in every brand, amidst an epidemic of runaway vehicles crashing into buildings. The brand most often involved is Toyota, but other brands are far from immune.

My journey with Toyota had scarcely begun when I began to realize what a profoundly crooked corporation I was dealing with. I just LOVE the Toyota dealership's new location. Now I won't have to rent storage space for my car to make sure it isn't vandalized while I'm picketing.

Update 6/12/2014 - Toyota's junk parade continues with another recall. A whopping 2.27 million vehicles because airbags could fail, also involving a fire hazzard. 20 models are on the list, including the Corolla, Yaris, and Noah. Note that as part of Toyota's recent federal criminal settlement, "...the automaker admitted that it lied when it insisted that it had addressed the "root cause" of the (unintended acceleration) problem by fixing floor mats that could trap the accelerator."

Update 6/14/2014 - Here's a video which puts Toyota's unintended acceleration scandal in proper perspective. There's now evidence GALORE of electronic defects in Toyota's throttle control. Read "Toyota's killer firmware: Bad design and its consequences." Embedded systems expert Michael Barr found the following, resulting in a guilty verdict in the landmark unintended acceleration case last October in Oklahoma:
* Toyota's electronic throttle control system (ETCS) source code is of unreasonable quality.
* Toyota's source code is defective and contains bugs, including bugs that can cause unintended acceleration (UA)
* Code-quality metrics predict presence of additional bugs.
* Toyota's fail safes are defective and inadequate (referring to them as a 'house of cards' safety architecture).
* Misbehaviours of Toyota's ETCS are a cause of UA

Acknowledged crook Toyota is being allowed to ignore Mr. Barr's findings, and drivers of runaway vehicles involved in crashes are being unjustifiably found at fault and charged accordingly.


Update 6/18/2014 - For another account of Mr. Barr's findings, published 2/26/2014, read "Toyota Code Could Be Lethal." As the author says, "Put simply, it's frightening enough to make you buy a pre-computer car." There's been a mainstream media news blackout regarding Mr. Barr's findings. Only a few trade journals have dared to publicize the facts.

Update 7/10/14 - See 6/14 update above. Mr. Barr's findings raise questions about the reliability of electronic throttle controls in all brands, and the facts are being exposed as the auto industry tries to delay having to implement fail-safes that have been mandated for years in the airline industry. Today there's news that Honda has admitted to electronic defects causing unintended acceleration and has recalled 175,000 hybrid vehicles. THIS IS THE FIRST TIME AN AUTOMAKER HAS MADE SUCH AN ADMISSION. STAY TUNED.

If Toyota can't do floor mats...

Toyota's latest recall - 2.5 million units - prompted an interesting response from Hagens Berman, one of the attorneys suing the Recall King over floor mats.  While Toyota's friends at NHTSA are proudly declaring an end to their investigation of sudden, unintended acceleration, Mr. Berman dared to point out that this latest recall stands in "stark contrast" to what Toyota has been saying about the floor mat issue.  Instead of backin' off, maybe NHTSA should be takin' a closer look.

Let's start with just how "voluntary" this recall actually is.  The terminology sounds good for the Recall King, but based on the facts, it sounds a little too good.  Smacks of another cozy deal with NHTSA, whereby Toyota gets to play word games.  Now don't get me wrong.  I'm delighted that Toyota is gettin' exposed and havin' to foot the bill - financially and PR wise - for this recall.  But its kinda like those "record setting" yet slap-on-the-wrist fines allowing Toyota to walk away without any admission of wrongdoing.  The punishment may be well deserved, but its hardly sufficient.

This latest recall is another credibility issue for the Recall King.  Folks had reason to believe that Toyota had solved the floor mat thing, only to discover that "the rest of the story" was - or is - yet to be told.  Wonder how long Toyota and NHTSA have known about these additional problems regarding floor mats?  As things now stand, nobody can be blamed for concluding that there's more to this story than we've been told.  One plaintiff in a sudden acceleration lawsuit has already spoken out, saying this latest recall is proof positive that unanswered questions remain.  And folks in Minneapolis are plannin' a demonstration - 3/22, 8-9 AM, 300 4th St. - to tell the feds to hold Toyota accountable for not installing brake overrides.  

So lemme get this straight.  Toyota has problems designin' floor mats, but the Recall King is okay with electronics?

Case of jailed Toyota driver affronts fairness

To begin with, it took nine months to file charges. Then there was the charge itself - vehicular homicide - which never did fit the facts of the case. Koua Fong Lee was returning home from church with his family when his Camry suddenly sped out of control on an exit ramp reaching speeds of 70-90 mph before crashing into another vehicle and resulting in the deaths of three people. Lee has steadfastly maintained that he repeatedly pressed the brake pedal but the car wouldn't stop, yet Lee's attorney (lest we forget, Lee is an immigrant who came to this country to escape dirt poor living conditions) sided with the prosecution by stating in his closing remarks to the jury that Lee probably mistook the accelerator for the brake.

Lee was found guilty, sentenced to a whopping eight years in prison, and would have remained quietly tucked away behind bars except for breaking news of sudden unintended acceleration in Toyotas. With a new lawyer, thousands registering support on a Facebook page, street protests, and mainstream media coverage, a hearing was held to determine if Lee should get a new trial. And that's where the story really gets interesting.

Lee's new attorney presented bombshell testimony showing that Lee's car had anti-lock brakes, accounting for the absence of skid marks. At Lee's "trial" there had been false testimony - by a city mechanic - stating that Lee's car did not have anti-lock brakes, and this testimony went unchallenged even though Lee's attorney had a letter from Lee's insurance company stating that the car's brake light was engaged. Sooo... with their opposition to a new trial smellin' worse than a kettle of rotten fish - and the case now making national headlines - the DA's office made a desperate, last ditch effort to dump the blame on Lee by offering to release him from prison if he would agree to drop his petition for a new trial and walk away a convicted felon. Talk about cheap shots. How many folks - with five and a half years of prison time to go - would have refused such an offer? If any, not many, and the prosecution knew it. But this time their victim had the courage of conviction - the sheer bravery - to turn down the offer, maintain his innocence, and proceed with his petition for a new trial. Applause, please, for Koua Fong Lee. Within hours - amidst a groundswell of public outrage over Lee's incarceration - the judge granted a new trial, the DA dismissed the charges declaring "this is over," and Lee was suddenly a free man with a clean record.

Well and good. But it's awfully strange how a mechanic can get a major piece of evidence wrong regarding something as readily verifiable as whether or not a car has anti-lock brakes. Ditto for a defense that allowed this testimony to go unchallenged. And wouldn't it have been a cozy deal for Toyota if Lee could have been bullied into takin' the blame and walkin' away a convicted felon while the matter conveniently faded from public view? Koua's criminal case is over, but it raises troubling questions galore.

Update 8/9/2010 - FB has blocked my Toyota posts from Posts by Everyone, and this morning, Twitter is once again blocking my tweets from real-time results. A new Facebook page (Toyota's cars kill innocent people. Stand up for the truth), and exposure of  false testimony, witheld evidence, etc. in the Koua Fong Lee case is turning up the heat on Toyota. Activists should monitor real-time publications for dirty tricks style censorship. Don't be dupped just because posts appear on profile pages, etc.

Congrats, Tony. Right on for picketing Toyota.

Like yours truly, Tony Scanaliato got so fed up with Toyota he decided to picket in front of his local dealership.  Too bad there aren't more customers using this technique to expose Toyota's wrongdoing.  Its certainly one way to circumvent censorship.  What Toyota needs, bless their little charged-with-racketeering hearts, is customers all across the country picketing in front of their dealerships.  Wouldn't it be great if everyone who signed the oil sludge petition marched with signs letting potential customers know what they're gettin' into if they deal with Toyota?  One thing's for sure.  Absent a high profile tragedy,  Ol' Uncle Scam's mainstream media certainly isn't gonna help.  The idea is to wrist-slap Toyota with a fine or two, hoping that'll make NHTSA look good, and keep quiet about everyday ripoffs such as oil sludge, strange engine noises, and stonewalled defects causing engines to disintegrate in MR2 Spyders.

Hooray for Tony Scanaliato exposin' the "Toyota Way."  Such a pity consumers have to exercise extreme tactics to obtain some semblance of fairness.

Toyota Center violates the law - I call the cops

Update 5/3/2011 - Management at the Toyota Center has changed hands since this was posted.  Current management has been sincerely concerned about incidents of this kind and has taken appropriate measures to ensure that such encounters will not happen in the future.

I finally had to call the cops on the Toyota Center.

Yesterday, while I was picketing, one of their thugs snatched my sign - ripping it apart in the process - and ran off into the Toyota Center. This was the same guy who had previously told me that what I was doing wasn't worth dying over, threatened me with his car, and said he would return with a "gang of technicians."

Can't say much for the West Columbia police department, either. They refused to arrest my assailant, and unnecessarily delayed me - despite my repeated requests - from getting home to check on my dad. Believe it or not, the first cop to arrive on the scene even told me that since I was protesting the Toyota Center, they "had a right to protest me." 'Course, maybe our local boys in blue are simply unaware that such things as theft, assault, malicious destruction of property, and death threats are somewhat less than legal. Then again, maybe they just have a soft spot in their tender little hearts for Toyota...

More bullying from Toyota

Update 10/30/10 -
This week, documents surfaced showing that on two occasions, Toyota service personnel drove vehicles to investigate customer complaints of sudden acceleration and verified that the customers' claims were correct. Toyota repurchased the vehicles and urged both customers to keep quiet, even requiring one of them to sign a confidentiality agreement.

Yahoo News censored my comments about this matter, and is now refusing to publish any comments I submit, regardless of the topic.
  
On 5/12/09, which was less than a week after I began directing people to this blog, I got a telephone cItalicall from Mr. Dave Adams - Southeast Toyota's "Customer Loyalty" guy - claiming he wanted to "help me get some of my money back." But it turned out to be exactly the kind of bullying I've come to expect from Toyota. Specifics - if you can call them that - were kept verbal (the trademark of someone who's tryin' to scam you), I would be expected to accept considerably less than my expenses, and I would be required to tow the line in terms of loyalty to Toyota. They don't call him the "Customer Loyalty" guy for nothin'. To ensure that Toyota was making a "good investment," I would "say nice things" about Toyota when I visited their dealerships, and this blog "might have to come down." Seems I also needed to "learn how to be a gentleman." Any more picketing, and the Customer Loyalty rep would see to it that I didn't get a dime. Even gave me a couple of days, he did, to "think things over." Yessir, he put on quite a performance. Flogged me good n proper for darin' to criticize Toyota, and simultaneously whined that my remarks about Toyota had "hurt his feelings."  Touchy folks, these "Customer Loyalty" guys. But things could have been worse. At least I wasn't required to buy a new Toyota...

Since Toyota refused to offer bonafide specifics and put them in writing, I finally made my position crystal clear. Sent 'em an e-mail stating that I better not settle for anything less than reimbursement for all of my expenses. Reminded 'em, I did, of the continuing problems I'm having with the engine they rebuilt. Unfortunately - as I've noted elsewhere on this blog - multiple engine failures are not uncommon. And incidentally, when it comes to hurt feelings, my feelings were also a wee bit challenged when I had to fork over thousands of dollars due to Toyota's improperly designed engine.

Point is, Toyota shouldn't profit from their design defect, and potential reimbursement shouldn't be held as a club over a customer's head. C'mon, Toyota. Clean up your act.

Engine failures in MR2 Spyders

Starting last year, I began picketing in front of the Toyota Center and Dick Dyer Toyota after these two dealerships and Toyota's corporate headquarters refused to make allowances for a design defect in Toyota's MR2 Spyders. Although Toyota has yet to include Spyders in the sludge fiasco, engines suddenly lose oil, disintegrate, and the exhaust system can also be ruined. I've been out $8,500 in repair bills - $2,000 to Dick Dyer and $6,500 to the Toyota Center - and all Toyota does is stonewall. For a multitude of cases like mine, visit this forum on SpyderChat.com. My Post is number 128. Notice that some customers have lost several engines in rapid succession, and some folks don't have the money for repairs, which leaves these unfortunate souls making payments on a car they can't use. Since Toyota refuses to address their design defect, I have been unable to obtain any assurance that the defect was corrected when my engine was rebuilt, such that my engine will not suddenly disintegrate again.

For an in-depth technical discussion of Toyota's design defect in MR2 Spyders, visit this forum on the British website, MR2 Roadster Owners Club. Like SpyderChat, the British club also features documented cases of engine failures in Spyders, and there are several other pre-cat related forums.

Note the legal issues encountered in Europe as well as this country when tampering with emission control equipment, such as removing pre-cats. Owners are placed in the untenable position of either risking a blown engine or violating the law in an effort to prevent losing thousands of dollars.

I accidentally discovered "the rest of the story" about engine failures in MR2 Spyders while browsing the Internet. It's way past time for a class action lawsuit aimed at forcing Toyota to satisfactorily resolve the outrageous number of engine failures in MR2 Spyders. If the problem is oil sludge, MR2 Spyders - and probably a number of other models - need to be included in the initial class action.  Spyder owners are a relatively small group compared to the number of folks who own other models, so class action lawsuits are less feasible. Apparently, this is the sort of thing Toyota relies on. Talk about a bully.

"Mr. T" must stand for thuggery

Dealership employees have complained to local law enforcement about me exercising my right to picket, have used four-letter filth, and have threatened me with bodily harm. Around midnight, about 48 hours after I complained to Toyota regarding Dick Dyer's sales manager (!) suggesting that I "get the f... outta here," I received two obscene phone calls emphasizing the f-word. Toyota's position on this sort of thing is that they have no control over their "independent" dealerships.

After I stopped picketing last Wednesday, two Toyota Center employees had hemmed in my car with two vehicles, and refused to allow me to exit, even after I told them I needed to get home to take my Alzheimer's stricken father to the bathroom. Instead, they sauntered around in close proximity. I finally managed - just barely - to get my car out, checked on my dad, and returned to picket some more. After a few minutes, someone with the Toyota Center came to talk with me about the risks of standing close to the road, during which time two or three cars barreled by and suddenly swerved toward me, abruptly cutting back to avoid a collision. Just another strange coincidence, I guess. Like those obscene phone calls...
